The Advisory Panel on Licensing of Hotels and Guesthouses ("Advisory Panel") is established under section 12N of the Hotel and Guesthouse Accommodation Ordinance ("the Ordinance"). Its functions are to -
- Invite the views of affected persons on the applications of the issue or renewal of hotel licences or guesthouse licences and consider their views.
- Consider the responses provided by the licence applicants to the views of affected persons.
- Conduct hearings when necessary.
- Advise and make recommendations to the Hotel and Guesthouse Accommodation Authority ("the Authority") on whether to approve or refuse the applications and whether to impose any conditions on the licence.

Under section 12N of the Ordinance, a local consultation exercise may be conducted before an application for a new licence or renewal of a licence is approved. The Advisory Panel appointed by the Authority will consider the views of affected persons and the response from the applicant before making recommendation to the Authority in respect of a licence application.
Affected person, in relation to a licence application for any premises, means –
(a) if the premises form part but not the whole of a building –
(i) an owner or occupier of any part of the building; and (ii) if the Authority considers appropriate – an owner or occupier of any other premises situated within 30m from the boundary of the building specified by the Authority for the application;
(b) if the premises form the whole of a building –
an owner or occupier of any other premises situated within 30m from the boundary of the building specified by the Authority for the application.
For a particular licence application, affected persons concerned will be notified and invited to submit their views to the Advisory Panel on or before a specified date. In case an affected person would like to give views on a licence application, he/she can complete the reply form and return it to the advisory panel secretariat through mail, fax or e-mail. Late submission of the reply form or an incomplete reply form may not be accepted by the Advisory Panel. Views from non- affected persons in respect of a licence application would not be considered by the Advisory Panel.
